New workplace rights coming into effect from today

August 26, 2024

South Australian workers are set to benefit from significant new workplace rights that come into effect today, following the passage of the ‘Closing Loopholes’ legislation by the Albanese Labor Government in February. These changes represent a major victory for working people, delivering fairness and security during a cost-of-living crisis.

The new laws include:
1. The Right to Disconnect: Workers now have the right to reasonably refuse out-of-hours calls and emails, reinforcing the importance of work-life balance.

2. A Clearer Definition of what it means to be an Employee: A clear and fair definition of what it means to be an employee, closing the door on sham contracting arrangements that have been used to exploit workers.

3. Pathways to Secure Work for Casuals: Better opportunities for casual workers to transition into
permanent positions, offering greater job security.

4. Rights for Union Delegates: Enhanced protections and rights for elected union delegates, ensuring they can advocate for their colleagues without fear of retaliation.

5. Union Rights for Gig Workers: Gig economy workers, including those working with platforms like Uber, Deliveroo, and Mabel, now have the right to unionise and negotiate for better pay and conditions.

"These new rights are a huge step forward, particularly for casual, and ‘gig-workers’. It’ll deliver more
secure jobs, get wages moving in the right direction, and strive for a better work/life balance for workers
all across the state.”

“These new workplace rights come at a crucial time, offering much-needed job security during a cost of
living crisis that hits insecure workers the hardest.”

“These achievements wouldn’t have been possible without the tireless efforts of unions and their members. This is a win for every worker who stood up and campaigned for better rights and protections.”

“Unions will continue to stand with workers to ensure these new laws are properly implemented. If you’re not getting these new rights in your workplace, speak to your union."
